Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Ovrimo LLC, which operates Makevo (“Makevo”, “we”, “us”). They govern your use of the Makevo mobile app and website at makevo.site (the “Service”). By creating an account, generating a design, or placing an order, you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) to make purchases, and you must meet the minimum age required by your app store to use the app. If you are under the age of majority, you may use Makevo only with the permission and supervision of a parent or legal guardian. By using the Service you represent that you meet these requirements and that the information you provide is accurate.

2. The Service

Makevo lets you generate artwork using artificial intelligence — from text prompts or from pet photos you upload — save designs, and order that artwork printed on physical products. Printing and delivery are handled by third-party print-on-demand and shipping partners. AI-generated results are inherently variable; we do not guarantee that any specific output, likeness, style, or text will be produced.

3. Accounts

You sign in through Google, Apple, or email. You are responsible for activity that occurs under your account and for keeping your login secure. Notify us promptly of any unauthorized use.

4. Credits

Credits are a limited digital balance used to access AI generation and other paid features in Makevo, as described in the app. Credits are not money, stored value, gift cards, or currency.

Credits have no cash value, are non-transferable, and may not be resold.
Failed or blocked generations do not consume a credit when our system determines the generation did not complete successfully.
Credits are generally non-refundable except where required by law or expressly stated by Makevo.
We may change free-credit amounts, promotional credits, or credit pricing on a going-forward basis.
Purchased credits do not expire unless required by law or otherwise stated at the time of purchase. Promotional or free credits may expire or be limited as described when offered.
If you delete your account, any unused credits may be forfeited unless otherwise required by law.

5. Your Content & License

“Your Content” means the prompts you enter, images you upload, and designs generated for you. As between you and us, you retain your rights in Your Content. You grant Makevo and its providers a worldwide, non-exclusive license to host, process, reproduce, and print Your Content solely to operate the Service and fulfill your orders.

You represent and warrant that you own or have all rights necessary to use Your Content and to have it printed, and that Your Content does not infringe any third party’s intellectual property, privacy, publicity, or other rights, and does not violate any law or these Terms.

6. AI-Generated Designs

AI-generated outputs may not be unique to you, and similar or identical outputs may be generated for other users. Makevo does not guarantee that any generated design is exclusive, copyrightable, trademark-safe, or free from similarity to existing works. You are responsible for reviewing generated designs before saving, sharing, or ordering products, and for ensuring that your prompts, uploads, and selected designs do not violate anyone else’s rights.

7. Acceptable Use & Content Policy

You agree not to create, upload, or order designs that include or depict:

copyrighted characters or franchise characters;
brand logos, trademarks, or trade dress;
real, identifiable people or celebrity likenesses (including photos of people’s faces) without permission;
explicit sexual content or pornographic nudity;
hateful, harassing, violent, exploitative, illegal, or abusive content;
minors in unsafe or inappropriate contexts; or
anything that otherwise violates applicable law or the rights of others.

We use automated and manual checks to screen prompts, uploads, and generated images. We may reject, block, remove, cancel, or refuse to print any design, prompt, upload, or order that we believe violates these Terms, infringes third-party rights, creates legal, safety, or reputational risk, or is otherwise inappropriate for Makevo — at our discretion and without liability. You are solely responsible for the content you submit and for ensuring you have the rights to it.

8. Orders, Pricing & Payment

Prices are shown in the app before checkout and may change over time. Applicable taxes and shipping are calculated at checkout. Payments are processed by Stripe; by placing an order you authorize us to charge your selected payment method for the total shown. We may decline or cancel orders (for example, for suspected fraud, pricing errors, or content violations).

9. Products, Fulfillment & Design Approval

Products are custom-made on demand by our print partners after an order is submitted. You are responsible for reviewing your design, product type, size, color, quantity, design placement, shipping address, and order details before placing the order. Because products are custom-made, small variations in color, placement, material, sizing, or print appearance may occur, and product mock-ups/previews are approximations rather than exact representations.

10. Shipping

Delivery windows shown in the app are estimates, not guarantees. We are not responsible for delays or issues caused by carriers, customs, incorrect or incomplete addresses you provide, failed delivery attempts, or other events outside our control. You are responsible for providing accurate shipping information. International orders may be subject to customs, duties, taxes, or import fees, which are your responsibility where they apply.

11. Cancellations & Refunds

You may request to cancel an order from the app before it enters production. Because products are custom-made on demand:

Once an order is submitted to production, it generally cannot be cancelled.
If a cancellation is confirmed before production, we will refund your payment.
Custom products generally cannot be returned or refunded for change of mind, for an incorrect size or product you selected, for incorrect shipping information you provided, or for design choices you approved before ordering.

If your product arrives damaged, defective, misprinted, or materially different from what you ordered, contact us at support@ovrimo.com or through the app’s “Need Help” feature within 14 days of delivery with your order information and clear photos of the product, packaging, shipping label, and the issue. We may offer a reprint, replacement, refund, or store credit at our discretion, unless applicable law requires otherwise.

12. Intellectual Property

The Service, including the Makevo name, logo, software, and website, is owned by Ovrimo LLC and protected by intellectual-property laws. These Terms do not grant you any rights in our marks or software except the limited right to use the Service as intended.

13. Third-Party Services

The Service relies on third parties — including AI generation providers (specifically OpenAI), payment processing (Stripe), authentication (Firebase), and print-on-demand/fulfillment partners (such as Printify and its production partners). Your use of the Service may be subject to those providers’ terms, and we are not responsible for their acts or omissions.

Sending your prompt or uploaded pet photo to OpenAI for AI processing requires your separate, in-app permission, which the app requests before any such data is sent. Accepting these Terms is not that permission, and does not by itself authorize AI processing of your prompts or photos. How this permission works, and how to withdraw it, is described in our Privacy Policy.

14. App Store Terms

If you download or access Makevo through the Apple App Store, Google Play, or another app marketplace, your use may also be subject to that marketplace’s terms, rules, and payment policies. The marketplace provider is not responsible for Makevo’s content, AI generations, products, fulfillment, support, refunds, or claims except as required by its own terms or applicable law.

If you download or use Makevo through the Apple App Store, the following also apply:

These Terms are between you and Ovrimo LLC, not Apple. Apple is not responsible for Makevo, its content, AI-generated designs, credits, printed products, order fulfillment, support, refunds, or any claims related to Makevo, except as required by applicable law.
Your use of Makevo must comply with Apple’s App Store Terms of Service and the Apple Media Services Terms and Conditions.
To the extent Makevo is considered a licensed application under Apple’s standard End User License Agreement, you are granted a limited, non-transferable license to use Makevo on Apple-branded products that you own or control, and as permitted by Apple’s Usage Rules.
Ovrimo LLC, not Apple, is responsible for providing any maintenance and support for Makevo, unless applicable law requires otherwise.
Apple is not responsible for investigating, defending, settling, or resolving any claim that Makevo or your use of Makevo infringes a third party’s intellectual property rights.
Apple and its subsidiaries are third-party beneficiaries of this section, and Apple has the right to enforce this section against you as a third-party beneficiary after you accept these Terms.

15. Suspension & Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access — with or without notice — if you, for example:

violate these Terms or misuse the Service;
abuse credits or promotions;
make fraudulent purchases or file improper chargebacks;
upload prohibited content or attempt to bypass our safety systems;
interfere with or disrupt the Service; or
create legal, safety, or compliance risk.

Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

16. Disclaimers

The service and all content are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated output may be inaccurate, unexpected, or unsuitable, and product mock-ups and previews are approximations — actual print appearance may vary. We do not warrant that the service will be uninterrupted, secure, or error-free.

17. Limitation of Liability

To the maximum extent permitted by law, Ovrimo LLC and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or unauthorized use, arising from or related to your use of the service. Our total liability for any claim relating to the service or an order will not exceed the greater of the amount you paid us for the order giving rise to the claim, or fifty US dollars (US$50).

18. Indemnification

You agree to indemnify and hold harmless Ovrimo LLC and its partners from any claims, damages, and expenses (including reasonable attorneys’ fees) arising from Your Content, your use of the Service, or your violation of these Terms or the rights of any third party (including intellectual-property or publicity-rights claims relating to designs you create or order).

19. Governing Law & Disputes

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Minnesota, unless applicable law requires otherwise.

20. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
